These terms govern your use of this website and your purchase of reports from Reliable Checks(“the Company”, “we”, “us”). By using the site or placing an order you agree to them. Please read the section on permitted use carefully. It is the most important part of this document.

Permitted use: this is not a consumer report

Reports supplied by the Company are intended for personal knowledge and general due diligence. They are not consumer reports as defined by the Fair Credit Reporting Act (FCRA), and the Company is not a consumer reporting agency.

You may not use the website, our services, or any information obtained from us, in whole or in part, as a factor in establishing an individual's eligibility for:

• Employment, promotion, reassignment, or retention
• Credit or loans
• Health insurance or any other insurance
• Housing, tenancy, or other accommodation
• Education, scholarships, or fellowships
• Benefits, privileges, or services provided by a business establishment
• A license or other benefit granted by a governmental body that is required by law to consider an applicant's financial responsibility or standing

If you need a report for any of those purposes, you must obtain it from a consumer reporting agency through an FCRA-compliant process. We will cancel and refund any order we believe is being placed for a prohibited purpose.

Age and eligibility

By accessing or using this website you represent that you are at least 18 years of age, or the age of majority in your jurisdiction of residence. We may require written proof of age. You further represent that the information you supply about a search subject was obtained lawfully and that your purpose in ordering is lawful.

Orders and acceptance

All orders are subject to our acceptance. After you place an order we send an email confirming receipt. We may refuse or cancel any order, whether or not it has been confirmed, for any reason and without liability to you beyond refunding amounts paid. Prices are stated in US dollars and may change at any time; the price that applies to your order is the price displayed when you placed it.

Accuracy and completeness

We compile reports from public records, commercial databases, and court sources, and we review results manually before delivery. We cannot guarantee that every record concerning a subject exists in an accessible source, is current, or is free of errors introduced upstream by the record holder. A report reflects what was found in the sources searched at the time of the search.

A report returning no records is a complete result. It means the searches were performed and nothing was located.

Your responsibilities

• Provide accurate subject information. Incorrect identifiers produce incorrect results, and we cannot be responsible for that outcome.
• Keep report contents confidential and do not republish or redistribute them.
• Do not use a report to harass, stalk, threaten, discriminate against, or otherwise harm any person.

Refunds

Our refund terms are set out on the Refund Policy page and form part of these terms.

Intellectual property

The website, its content, and the format and presentation of our reports are owned by the Company. You receive a personal, non-transferable right to use the report you purchased for your own lawful purposes.

Disclaimer of warranties

The website and reports are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, the Company will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of your use of the website or any report. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

Indemnity

You agree to indemnify and hold the Company harmless from claims, losses, and expenses arising from your misuse of a report, your breach of these terms, or your violation of any law or the rights of a third party.

Arbitration

Except where expressly provided otherwise, you and the Company agree that all claims, disputes, or controversies between you and the Company (including its parents, affiliates, subsidiaries, related companies, predecessors in interest, successors, assigns, and their respective directors, officers, employees, and contractors) that have arisen or may arise shall be resolved by final and binding arbitration.

Class action waiver

Separate and apart from the agreement to arbitrate above, and to the maximum extent permitted by law, each party independently waives any right to bring or participate in a class action, private attorney general action, or other representative action of any kind against the other.

Changes to these terms

We may revise these terms at any time. The date at the top of this page reflects the current version, and continued use of the site after a change constitutes acceptance of it.
